Representing a husband in financial remedy proceedings in a long marriage case with assets in excess of £7 million. Unmatched contributions were successfully argued, and the husband’s wealth accumulated prior to marriage was “ring fenced” and retained by the husband together with his share of the assets acquired post marriage.
Representing a husband in financial remedy proceedings where the husband owned one third of a successful international business valued at over £30 million by the Court appointed expert. Successfully applied to the Court for a further expert valuation, which valued the business at just under £20 million. Successfully negotiated settlement based on the lower valuation.
Successfully representing the father of the Wife as intervener in financial remedy proceedings where he was owed close to £80,000 by the parties, which the Wife accepted but the Husband denied. Costs order made in father’s favour.
Representing a wife in financial remedy proceedings where her ex-husband had defaulted on a lump sum payment of £605,000; successfully enforcing and obtaining payment as a result of issuing a Judgement Summons.
Representing a wife in financial remedy proceedings where Husband had pleaded guilty to 17 offences of sexual assault on his own children and grandchildren when they were minors and is serving a lengthy prison term.
Representing a professional lady in acrimonious financial remedy proceedings, where the parties had substantial income, a portfolio of investment properties and significant pensions, and in which both parties’ parents had been involved in the proceedings, successfully settling the case shortly before final hearing, which avoided what would have been an expensive and emotionally stressful 8-day hearing in the Central Family Court.
Michael has assisted many clients obtaining Decree Absolute in their divorce proceedings over the past 29 years.
Michael is fully up to date with the new law allowing all parties to divorce on a non- fault basis. He looks forward, in this new era, to assisting clients in ending their marriage without assigning blame or having to wait up to 5 years after separation from their spouse.
Representing a client in Schedule 1 Children Act 1989 proceedings where the father was a retired international sportsman which settled 1 week before trial.
Representing the mother of a teenage son in Children Act proceedings in which the son did not wish to see his father for more than a few hours a week, securing an outcome acceptable to the mother; successfully opposing enforcement applications made by the father when the son refused to see him and subsequently varying the sons contact to indirect contact only.
Michael has advised many clients who are not married as to their financial position following a breakup of the relationship including cases where one or both of the parties are legal owners of the former family home. He has also acted for client’s seeking the sale of property whether it be in equal or unequal share. Michael regularly assists his clients to settle their claims through mediation.
Michael has a wealth of experience in advising clients and obtaining non-molestation orders, occupation orders, and where children are involved, specific issue orders.
Michael has drafted and advised many clients on pre and post nuptial agreements.
Michael has advised unmarried client’s as to their legal rights in respect of property jointly owned with their partner and drafted Cohabitation agreements and Trust Deed which define the party’s ownership of their home and their respective rights and obligations in the financial running of it.
