How we guide you through separation agreements
A separation agreement is a formal document which is used to set out the arrangements you have agreed in relation to finances, for instance the sale of property, transfer of assets and payment of spousal or child maintenance.
Navigating separation can be overwhelming. A separation agreement brings certainty, reduces conflict, and supports a more amicable separation prior to divorce proceedings being started. In order for a separation agreement to be prepared, you need to have undertaken financial disclosure. A pension sharing order cannot be made as part of a separation agreement. A separation agreement may be upheld by the court in due course, but it cannot be guaranteed.

Why choose a separation agreement?
Separation agreements are useful to parties who for a variety of reasons may not want to divorce immediately but who require clarity in relation to their financial separation.
Whilst not automatically binding it is useful if you are not yet ready to embark upon divorce proceedings. The agreements can cover all aspects of how assets are transferred or sold, as well as spousal and child maintenance.
We will help you prepare a separation agreement that is straightforward, fair, and built with your future in mind. This document gives clarity and certainty, often helping avoid disputes and costly court involvement later.
Our approach is rooted in empathy and respect; we know that separation affects not just legal matters but your family’s emotional wellbeing too. Whether your circumstances are straightforward or more complex, our experienced team will guide you step-by-step, ensuring peace of mind at every stage.
We are proud that our work is recognised by leading legal rankings such as Legal 500, which reflects our commitment to excellence and client care. Together, we’ll build a strong foundation for your next chapter – one marked by clarity and confidence rather than uncertainty.
Separation agreement FAQ’s
We understand you might be looking for answers to some unanswered questions so we’ve compiled a list of frequently asked questions to help get you started.
A separation agreement is a legal document outlining how you and your partner will handle finances and property after separation. It helps avoid misunderstandings and disputes later.
Yes, subject to certain conditions. The agreements should be based on full financial disclosure. Each party should have had an opportunity to take independent legal advice. The agreement should be made without duress or pressure and result in a fair and equitable division.
Although not strictly binding, a separation agreement can set out practical day to day arrangements such as where the child will live, how much time they will spend with each parent and holiday and special occasion plans. A separation agreement can also include informal child maintenance agreements.
Separation agreements can be flexible and if your circumstances change then we are able to assist you with reviewing, updating and formalising the changes where necessary.
Not usually. A well-prepared separation agreement can prevent the need for court proceedings by resolving matters amicably. However, if pensions are to be shared you will need a Court Order.
