Land Acquisitions

On an acquisition, our solicitors are always thinking ahead to the next stage of the development process.  As part of the acquisition procedure, we consider all issues which could affect development finance for the site or any issues which could affect future plot sales.  Our expert land development team will:

  • Investigate the legal title to the land.
  • Carry out searches to include local authority and highways searches (it is important to know how access will be obtained to the future site and that the site abuts a public highway or other satisfactory arrangement is in place).
  • Consider any rights of light issues.
  • Consider any rights of way the land may benefit from including whether that right is sufficient enough to be passed on to future plot buyers.
  • Carry out a full site inspection.
  • Report fully on the purchase contract, title and other related issues.
  • Consider whether any early access licenses to carry out surveys and investigations are required and, if so, draw up the necessary documentation
  • Consider any rights you may need over adjoining land, for example, for the passage of services etc.
  • Consider what rights others may have over the land being purchased and advise on how they may affect your potential build process.
  • Advise on any overage provisions within the contract documentation.

Please also be aware that acquisition contracts may be conditional or unconditional.

Land Sales

Time is often critical when it comes to land sales; our land development solicitors will ensure that the sale is completed as quickly as possible whilst protecting the vendor’s position.

Our land development team will:

  • Draft the sales contract, whether it be conditional or unconditional.
  • Draft and advise on any overage provisions to be included in the deal.
  • Advise on stage payments of sale price, and how to protect any future payments due under the contract such as by way of legal charge.
  • Draft any documentation relating to assignment of warranties, assignment of copyright etc.
