Scams, Security and Safeguards: How LPAs Can Protect You and Your Loved Ones

Reports of SMS messages claiming to be from the Department for Work and Pensions (DWP) have surged in recent months. The scammers will typically claim that an application has not been submitted for the 2024-2025 Winter Heating Allowance and that the information previously provided is incomplete or incorrect. The nature of these messages are carefully worded to make even the most cautious individual believe they are legitimate. These messages often suggest that an individual may lose their entitlement to the allowance if the application is not submitted by a specified date.

The Risks

These messages may unfairly trick the most vulnerable, who may believe these messages to be true. Falling for such scams can result in financial loss, misuse of personal information and significant emotional distress. Given these risks, putting safeguards in place such as a Lasting Power of Attorney (LPA) is essential to protecting both an individual’s finances and personal wellbeing.

What is a Lasting Power of Attorney (LPA)?

A Lasting Power of Attorney is a legal document whereby an individual (the Donor) appoints trusted people (Attorneys) to make decisions on their behalf. This ensures that both financial and personal matters are managed responsibly, particularly if the Donor’s capacity to make informed decisions is affected by illness or other circumstances.

It is advisable to create an LPA at the earliest opportunity.

What Types of Lasting Power of Attorney Are There?

There are two types of Lasting Power of Attorney that an individual can create:

Property and Financial Affairs LPA – allows appointed Attorneys to make decisions regarding the Donor’s financial affairs. Such decisions may include, but are not limited to, managing bank accounts, paying bills, and handling other financial matters in the event that the Donor is unable to manage such affairs themselves.

Health and Welfare LPA – is another LPA where Attorneys can make decisions regarding an individual’s care such as living arrangements, medical treatment and daily care.

By appointing a trusted person to manage financial or personal decisions, an LPA ensures that vulnerable individuals have someone authorised to act on their behalf, helping to prevent exploitation and protect both their finances and wellbeing.
