Grant extraction service

Navigating the process of obtaining a grant of Probate can be complex and emotional. Our grant extraction service guides you smoothly through every step, ensuring peace of mind during a difficult time.

Personal Probate Grant extraction service

Guiding you through the grant of probate process

A grant of probate is the legal document obtained from the Probate Registry that enables an executor to administer and distribute a deceased person’s estate.

When someone passes away leaving assets in their sole name, it is usually necessary to obtain a grant of probate. This is a formal document issued by the Probate Registry that gives the executor the legal authority to collect and manage the estate’s assets. At Pinney Talfourd, we understand that this process can feel overwhelming, especially during what is already a challenging and emotional period. Our experienced team is here to shoulder the legal complexities, so you can focus on remembering your loved one.

Our grant extraction service involves preparing detailed estate information, managing legal documentation, and liaising directly with the Probate Registry. We ensure applications are thorough and accurate, minimising delays and avoiding common pitfalls that can prolong the administration. As a firm recognised in the Legal 500 for our probate expertise, our approach blends meticulous professionalism with compassionate support.

A grant of probate cannot be obtained until the estate has paid the correct amount of Inheritance Tax. We’ll advise and assist with the preparation and filing of the Inheritance Tax forms and arrange payment of the tax. We work with you from the outset, helping to gather necessary documents, advising on asset valuations, and preparing the official application for the grant. Our service is designed to keep you informed and reassured at every stage. We value clear communication and take the time to explain each step in straightforward language – no legal jargon, just honest and professional advice.

The grant extraction process explained

Obtaining a grant of probate is the first crucial step in legally administering an estate. Our service covers all essential aspects.

From the initial consultation, we’ll help you gather vital documents such as the Will, death certificate, and inventory of assets. Understanding estate valuations is key, so we work closely with you to assess all property, investments, and other assets.

We then compile the legal application, preparing detailed forms for submission to the Probate Registry. Monitoring progress closely, we manage any requirements for additional information or enquiries. Once the grant of probate is issued, we promptly deliver it to you, enabling you to proceed with the estate administration confidently.

If the estate is liable to Inheritance Tax, we will assist with the preparation and filing of the Inheritance Tax return and arrange for the tax to be paid.

We appreciate that delays can be frustrating, so we keep track of deadlines and communicate regularly, ensuring you’re never left wondering about the status of your application.

By choosing Pinney Talfourd, you benefit from a seamless, professional service backed by a firm whose integrity and commitment to client care are recognised throughout the legal sector.

Grant extraction service FAQs

We understand you might be looking for answers, so we’ve compiled a list of frequently asked questions to help get you started.

What is a grant of probate and why is it needed?

A grant of probate is a Court order authorising an executor to deal with a deceased person’s estate. It is usually necessary to obtain one when assets are held in the deceased’s sole name.  It enables executors to take control of the estate assets and distribute them in accordance with the Will.

How long does the grant extraction process take?

Times can vary based on the estate’s complexity and whether all documentation is available. Typically, it takes several weeks from application to the grant’s issuance, but we aim to make the process as swift as possible.

Can you obtain a grant if there is no Will?

Yes, but the process differs. In such cases, known as an intestacy, letters of administration are needed instead. We are fully experienced in handling this too.

What happens if the estate is liable for inheritance tax?

We’ll advise and assist with the preparation and filing of the Inheritance Tax forms and arrange payment of the tax. We ensure compliance with HMRC’s strict payment deadlines to avoid any penalty interest that may otherwise become payable.

Is your service suitable for executors without legal knowledge?

Absolutely. We guide you clearly through each step, providing dedicated support so you feel confident throughout the process.
