What is a separation agreement and why do I need one?

A separation agreement is a legal document outlining how you and your partner will handle finances and property after separation. It helps avoid misunderstandings and disputes later.

Is a separation agreement legally binding?

Yes, subject to certain conditions. The agreements should be based on full financial disclosure. Each party should have had an opportunity to take independent legal advice. The agreement should be made without duress or pressure and result in a fair and equitable division.

How do we manage arrangements for our children?

Although not strictly binding, a separation agreement can set out practical day to day arrangements such as where the child will live, how much time they will spend with each parent and holiday and special occasion plans.  A separation agreement can also include informal child maintenance agreements.

What happens if circumstances change after the agreement is made?

Separation agreements can be flexible and if your circumstances change then we are able to assist you with reviewing, updating and formalising the changes where necessary.

Do I have to go to court if I have a separation agreement?

Not usually. A well-prepared separation agreement can prevent the need for court proceedings by resolving matters amicably. However, if pensions are to be shared you will need a Court Order.
