Pension Implications on Divorce

Solicitors in Essex & London

Pensions accumulated by either party to the marriage are an asset of the marriage, whether held by the husband or wife.

The court will deal with the division of pension assets, applying the same principles that apply when dividing capital assets. However, due to the unique nature of pensions, expert advice may be required from a pension actuary as money held in a pension is not dealt with in the same way as other financial assets. Our divorce law solicitors can advise you further on the implications on your pensions during the divorce procedure.

An offsetting, earmarking or pension sharing order may be appropriate. Clients often need input from an Independent Financial Advisor at an early stage and our family solicitors are able to recommend advisors whom we work with regularly to ensure the best possible outcome for you and your family.
