Once a house builder has acquired land, our land development solicitors will assist with every aspect of preparing for the ultimate plot sales once the individual properties are built and complete. 

Even if we did not act for you on the acquisition of the site, our lawyers have significant experience in dealing with site set-up and plot sales, and have worked with many developer clients across Essex, London and further afield.

Our team of land development solicitors have site set-up expertise in the following areas:

  • Registration with warranty providers such as NHBC, LABC etc.
  • The preparation of land registry compliant conveyance plans.
  • Obtaining Estate Boundary Approval and Estate Plan Approval of conveyance plans from Land Registry.
  • Advising on the main access in to the development and any shared areas, and how they will be maintained, including whether a management company needs to be set up.
  • Creating a management company for common areas/facilities if required.
  • Drafting sales contracts, transfers of part, leases etc.
  • Obtaining prior approval of the transfer and leases from Land Registry.
  • Drafting rent charge deeds.
  • Considering in advance questions that may be raised by buyer’s solicitors and drafting standard replies to enquiries.
  • Creation of information packs to be sent to buyer’s solicitors with papers to cut down on the enquiries that need to be raised.
  • Advising on service charge budgets and service charge zones so as to tie in with the leases if required, and liaising with the managing agents accordingly.
  • Ensuring any planning obligations contained in S106 Agreements or Unilateral Undertakings are complied with in the sales documentation.
  • Advising on compliance with national consumer code for homebuilders.
  • Advising on Affordable Housing Elements of sites, and drafting documentation relating to disposal to Qualified Development Bodies.
