Danielle’s Trust experience includes drafting Deeds pertaining to existing Trusts and including Trusts within Wills.
Appointing and retiring Trustees from a Nil Rate Band Discretionary Trust following the recent death of a Testator and transferring the £325,000 of the value of the matrimonial home into the names of the Trustees.
Danielle has experience in a wide range of Wills including those with Care Fee Protection, Estate Succession and Inheritance Tax Planning.
Preparation of a Will to include a Discretionary Trust of Property to maximise Agricultural Relief from Inheritance Tax.
Preparing Wills for clients to contain two individual Discretionary Trusts for family members who were incapable of managing their finances.
Preparation of a Will for a client who was widowed and subsequently had a child with a new partner. The Will was structured to guarantee the latter partner had the protection of a property during her lifetime whilst ensuring the property would ultimately benefit all children, including those from his previous marriage. Also advising the client as to ways to mitigate Inheritance Tax to secure three Nil Rate Band allowances.
Danielle is developing her practice in the Court of Protection field and has experience of Deputyship and Trustee Orders where a person has lost capacity.
Preparing Applications to the Court of Protection for a Deputyship Order for a person who had lost capacity, together with a supporting application for a Trustee Order to appoint Trustees of a Life Interest Trust created under the incapacitated person’s late spouse’s Will from 1985; also advising the family in relation to a claim by the Local Authority who were pursuing the incapacitated persons’ property for payment of care fees.
