Land and Boundary Disputes
At Pinney Talfourd LLP we have a wealth of expertise in dealing with land, property and boundary disputes and have recently acted for a number of clients regarding encroachment and disputed rights of way.
If a dispute arises, it is necessary to establish who owns the disputed land. The primary evidence will be contained in the Deeds and legal documents.
We will look closely at the Title deeds and plans which may be conclusive and will assist in dealing with the dispute. We will consider if any clause in the conveyance describes the land by reference to physical or natural objects.
It should be noted that the Land Registry title plans only record the general position of property boundaries. They do not define the precise or exact boundaries and may have been changed by agreement or encroachment. The same problems arise with Ordnance Survey maps as they do not map the exact boundaries.
We recommend to all our clients that they consider alternative dispute resolution procedures before pursuing legal proceedings as many land and boundary disputes can be settled without the need for court proceedings.
