Discrimination (sex, race, disability, age, religion, belief, orientation)

Discrimination can occur in various situations and circumstances in relation to the different grounds listed above.

Events before, during and after employing a member of staff may give rise to a claim and the claim against you can be extremely costly and damaging to your business.

No qualifying period of employment is needed to make a discrimination claim, unlike an unfair dismissal claim where an employee requires at least 1 year continuous service. A claim that the dismissal was discriminatory can be made without any qualifying period of service.

As an employer it is best to safeguard yourself by monitoring and promoting an Equality and Diversity Policy and ensure that your methods are working effectively. By doing this you are promoting good business practice. As an employer, you may be held responsible for any discriminatory action by your employees if you cannot show that you took steps to try and prevent such action occurring.
